		<description>It is sad, but with today&#039;s political/social climate, I have to put
a preface on this.  I am not Pro-Slavery.

If you assume that Lincoln and the &#039;Union&#039; were correct, then the
Confederate States had no right to seperate from the United States
of America.  If that is the case, then they are still States.  
If they are still States, they would have to ratify any Ammendment
passed in order for it to become Law.  They didn&#039;t.  So, you can 
make a descent arguement for the Ammendments being invalid.  
(The 13th was ratified in December of 1865 I believe.)

As for the Interstate Commerce Clause, that is the Justification 
good ol&#039; Abe used to free those Slaves in the Confederate states 
(Deleware, Maryland, and Kentucky were still allowed to have 
Slavery ... see, because they were loyal States)with the 
Emancipation Proclamation in 1863, before any Ammendment was 
ratified regarding the issue.

It&#039;s an interesting arguement, and you are both right ... each to a 
degree.

		<description>I read somewhere that the abuse of the interstate commerce clause abuse can be traced back to Abraham Lincoln.  Lincoln used the clause to free the slaves (among other things) - beacuse they were traded across state lines.</description>
