DC Handgun Ban Ruled Unconstitutional
Look to SayUncle for a decent round-up of blogging on it. No need for me to repeat all those links.
In short the 30 year old Washington DC handgun ban has been ruled unconstitutional by the Fifth Circuit Court.
Most importantly, however, was that in the majority opinion they affirmed that the 2nd amendment insures an individual right and not a collective one. Or, put another way they said that the words “A well regulated militia being necessary to the security of a free state, the right of the people to keep and bear arms shall not be infringed” means that the right is secure by the people.
Imagine that. The words “the right of the people” actually referring to the rights of the people.
By golly, the legal logic they must have had to jump through to come to that conclusion must be astounding!
I’ll comment more on this later. Anythin I’ve tried puttting together at this point is rather rambling and not well formed.
